Terms of Service

1. Acceptance of Terms

By using the Email Notifications in the ZFS Module, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the ZFS. Continued use constitutes acceptance of the Terms.

2. Service Description

The ZFS Email module is part of the 45Drives Houston UI, which allows you to manage your ZFS storage pools and related configurations. Enabling email notifications allows you to receive alerts and updates whenever ZFS-related events occur, such as pool health changes, scrubs, or errors. This feature uses OAuth or SMTP-based authentication to securely deliver notifications to your chosen email address.

3. User Responsibilities

By using the ZFS Email Notification module, you agree to:

• Use the module in compliance with all applicable laws and the terms of service of any third-party email providers you connect to.
• Securely manage your OAuth credentials and SMTP configurations.
• Ensure your server remains protected and up to date to prevent unauthorized access.
• Promptly notify 45Drives if you suspect any unauthorized access or misuse of your configuration data.

4. Limitation of Liability

• No Warranty or Guarantee: The ZFS module is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. 45Drives does not guarantee that the module will be error-free, secure, or uninterrupted.
• Exclusion of Certain Damages: 45Drives is not liable for any incidental, special, consequential, or exemplary damages, including but not limited to loss of data, missed notifications, or business interruptions, arising out of or in connection with the use of the ZFS module, even if advised of the possibility of such damages.
• Limitation of Liability Amount: In no event shall 45Drives’ total liability for any claims related to this module exceed the amount paid by the user for the use of the service in the 12 months preceding the claim, if applicable.
• Third-Party Providers: 45Drives is not responsible for the performance, availability, or reliability of third-party email service providers (e.g., Google Gmail or other SMTP services) or the APIs they provide. Users acknowledge that these services are governed by the terms and conditions of their respective providers.
• User Misuse: 45Drives is not liable for damages caused by user errors, misconfigurations, or failure to properly secure credentials and access.
• Security Risks: While 45Drives implements reasonable security measures within the module, no system is entirely immune to risks. 45Drives disclaims liability for any unauthorized access, hacking, or security breaches affecting user data.
• Force Majeure: 45Drives is not liable for delays or failures in performance caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, labor disputes, government actions, or interruptions in Internet or telecommunications services.
• Indemnification: Users agree to indemnify and hold 45Drives harmless from any claims, damages, or expenses arising out of their use of the ZFS Email Notification module, including but not limited to violations of these Terms, misconfigurations, or misuse of third-party services.

5. Privacy and Data Security

45Drives does not store or retain user OAuth credentials. Users are responsible for securing their own data.

6. Termination of Service

45Drives reserves the right to terminate or suspend the ZFS at any time, with or without notice, for any reason, including but not limited to violations of these Terms.

7. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Nova Scotia, Canada. Any disputes arising from these Terms will be resolved exclusively in the courts of Nova Scotia.
